1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Aura Technologies, Inc. ("Aura," "we," "us," or "our") governing your access to and use of the Aura website, mobile application, and related services (collectively, the "Service").
By creating an account, clicking "Sign Up," or otherwise accessing the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
2. Eligibility & Age Requirements
Age 13+You must be at least 13 years of age to create an Aura account. By creating an account, you represent and warrant that:
- ✓You are at least 13 years of age
- ✓If you are between 13 and 18, you have obtained verifiable parental or guardian consent
- ✓You have the legal capacity to enter into a binding contract
- ✓You are not prohibited from using the Service under applicable law
- ✓You will provide accurate and truthful information when creating your account
If we discover that a user is under 13, we will immediately terminate their account and delete all associated data in compliance with COPPA. Parents or guardians who believe a child under 13 has created an account should contact us at [email protected].
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- ✓Use a strong, unique password and enable two-factor authentication where available
- ✓Notify us immediately at [email protected] if you suspect unauthorised access to your account
- ✓Not share your account credentials with any other person
- ✓Not create more than one personal account
- ✓Keep your account information accurate and up to date
4. Acceptable Use
Aura is designed for private family sharing. You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. Acceptable uses include:
- ✓Sharing personal photos, videos, and updates with approved family members and close friends
- ✓Managing access control for your private family circle
- ✓Communicating privately with approved members of your Aura
- ✓Storing and organising family memories in your encrypted Photo Vault
5. Prohibited Conduct
You must not use the Service to:
- ✗Upload, share, or distribute child sexual abuse material (CSAM) or any content that sexually exploits minors — this will result in immediate account termination and reporting to NCMEC and law enforcement
- ✗Harass, bully, threaten, or intimidate any person
- ✗Share content that is defamatory, obscene, or violates any third party's intellectual property rights
- ✗Impersonate any person or entity, or falsely represent your affiliation with any person or entity
- ✗Attempt to gain unauthorised access to any part of the Service or another user's account
- ✗Reverse engineer, decompile, or disassemble any part of the Service
- ✗Use automated tools, bots, or scrapers to access the Service
- ✗Circumvent, disable, or interfere with any security or access control features
- ✗Use the Service for any commercial purpose without our prior written consent
- ✗Violate any applicable local, national, or international law or regulation
Violation of these prohibitions may result in immediate account suspension or termination, and may be reported to appropriate law enforcement authorities.
6. Your Content
You own your content. By uploading or sharing content on Aura, you grant us a limited, non-exclusive, royalty-free licence to store, process, and deliver that content solely for the purpose of providing the Service to you and your approved family members.
This licence does not permit us to:
- ✗Use your content for advertising or marketing purposes
- ✗Share your content with third parties beyond what is necessary to deliver the Service
- ✗Train AI or machine learning models on your content
- ✗Decrypt or view your end-to-end encrypted content
You represent and warrant that you have all necessary rights to share the content you upload, and that your content does not violate any third party's rights or any applicable law.
7. Subscription & Billing
Aura offers paid subscription plans. By subscribing, you agree to the following:
- →Subscriptions are billed in advance on a monthly or annual basis
- →Annual subscriptions receive a 20% discount compared to monthly billing
- →Payments are processed by Stripe. Aura does not store your payment card details
- →Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
- →You may cancel your subscription at any time from your account settings
- →Refunds are provided on a pro-rata basis for annual subscriptions cancelled within 14 days of purchase
- →We reserve the right to change pricing with 30 days' notice to existing subscribers

8. Termination
By you: You may terminate your account at any time by going to My Profile → Settings → Delete Account. Upon termination, your account and all associated content will be permanently deleted within 30 days.
By us: We reserve the right to suspend or terminate your account immediately, without notice, if we determine that you have violated these Terms, particularly the prohibited conduct provisions. We will provide notice and an opportunity to appeal in all other cases.
Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, indemnification, and limitation of liability) shall survive.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure. While we implement industry-leading encryption and security practices, no system is completely immune to security incidents. You use the Service at your own risk.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AURA TECHNOLOGIES, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF:
- →The total amount you paid to Aura in the 12 months preceding the claim, or
- →USD $100
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Aura Technologies, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights or privacy rights; or (d) any content you submit, post, or transmit through the Service.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law provisions.
Informal resolution: Before filing a formal claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
Arbitration: Any dispute not resolved informally shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Delaware. You waive any right to a jury trial or to participate in a class action lawsuit.
13. Changes to These Terms
We may modify these Terms at any time. We will provide at least 30 days' notice of material changes via email and an in-app notification. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance. If you do not agree to the revised Terms, you must stop using the Service and may delete your account before the effective date.
